Analyse juridique de l’Accord UE-Turquie autour de trois axes: forme, contenu, effectivité

Among the recent legal tools set up to manage the migration crisis in the European Union area, the EU-Turkey Deal still stands out for its highly controversial content and nature. Concluded on March 18, 2016 through a joint statement of the Members of the European Council and their Turkish counterpart, the Deal met with various criticism from both institutional actors and civil society. Several judicial proceedings concerning the legality of the Deal have also been brought by individuals before the European courts and are currently pending before them. This article critically analyses the content and the form of this instrument through the prism of international and EU Law. It also discusses its institutional implications, which, it is submitted, have significant repercussions on the effectiveness of the EU strategy aimed at tackling the migration crisis.
