Restrictions adopted by States to manage and to contain the current pandemic have a significant impact on the protection of the fundamental rights of migrants, and in particular to asylum and international protection seekers. However, the exceptional nature of the health emergency we are experiencing does not affect the mandatory nature of a fundamental core of rules, including the principle of non refoulement, which assumes a central importance in this context. This brief contribution is specifically dedicated to the analysis of the assumptions, characteristics and limits of this principle, in order to verify whether and to what extent the advent of the current pandemic represents a suitable condition to affect the absolute and mandatory nature of the ban of refoulement.
