The article focuses on some fragments of Foucault's work from which, in the second half of the 1970s, a critique of the «droits de l'homme» emerges and leads to the sketch of a «droit des gouvernés». The Foucauldian perspective is questioned starting from the positions taken on the affaire Croissant and on the issue of Vietnamese refugees. These political events are important to understand the Foucauldian thematization of the need for a new form of right and for a «politics of the governed» capable of injecting new democratic substance into the worn-out legal machine of human rights.
