La condition juridique de la victime à travers le prisme des juridictions pénales internationalisées

The victims of international crimes, gross violations of international human rights law and serious violations of international humanitarian law have gradually received increased consideration in the international order. The development of legal instruments in terms of access to justice and reparation, the adoption of remarkable case-law decisions, as well as the creation of innovative institutional solutions have indeed contributed to this development, with the aim of ensuring gradually to the victims adequate protection and appropriate rights. In this regard, the field of international criminal justice appears to be a particularly fruitful, although extremely varied, experimental laboratory for carrying out this type of analysis. There is a development of a complex debate concerning the role played in the international criminal trial by victims, who fit, problematically, into the classic dichotomy between prosecutor and accused.
