This article analyses the relationship between the protection of minorities and the fundamental right of non -discrimination in the international and european law, in the light of the development of the individual right to enforce the principle of equal treatment. In this context, one must take into account some legal remedies provided for by European Directives in favour of persons who consider themselves victims of direct or indirect discrimination. On this point the article highlights the role played by the European Court of Justice in some law cases where the principle of equal treatment has been established. In this respect we shall welcome the recognition to all individuals, even not belonging to any protected group, of the right to denounce and to challenge cases of discrimination arising from national legislation or administrative practice of States.
